Tagungsband: De la dictature à l’état d’exception

Der von Marie Goupy und Yann Rivière geplante Tagungsband mit dem Titel “De la dictature à l’état d’exception. Une approche croisée de l’exceptionnalité – droit, histoire et philosophie” ist von den Éditions de l’École française de Rome zur Publikation angenommen worden.  Er wird voraussichtlich Ende 2021 erscheinen. Ein vorläufiges Inhaltsverzeichnis kann hier eingesehen werden.

Nachfolgend der französisch- und englischsprachige Abstract zu meinem Beitrag “Entre récupération de la démocratie et normalisation d’autoritarisme. Esquisse d’un cadre analytique de l’état d’exception”:


FR – Les états d’exception peuvent être compris comme une pratique complexe d’intervention en cas de crise. Ils permettent à l’exécutif d’agir sur la base de capacités renforcées, par rapport aux temps normaux. Une analyse appropriée d’un état d’exception nécessite une approche pluridisciplinaire et une perspective empirique apportée, qui couvrent la crise initiale, les conditions juridiques, l’action exécutive spécifique et le discours politique. L’évaluation de ces quatre dimensions permet de mieux décrire les conditions de l’état d’exception analysé. En outre, une telle évaluation nous permet de mieux comprendre les circonstances dans lesquelles une intervention de crise d’un exécutif renforcé pourrait mettre en danger la culture démocratique.


EN – States of exception can be understood as a complex practice of crisis intervention. These allow the executive to act on the basis of enhanced capacities, compared to normal times. An appropriate analysis of a state of exception requires a pluridisciplinary approach and a brought empirical perspective, which cover the initial crisis, legal conditions, specific executive action, and political discourse. The evaluation of these four dimensions helps describe better the conditions of the state of exception being analysed. Furthermore, it may enable us to better understand the circumstances under which a crisis intervention of an enhanced executive might endanger democratic culture.

Marie Goupy: The State of Exception Theory of Carl Schmitt and the Ambivalent Criticism of Liberalism

Against the classical approach of the state of exception—which tends to assume that the state of exception is the correlate of every constitutional State—this paper argues that this concept has to be apprehended in its contemporary specificity. It first emerged during the interwar period in legal doctrines concerning emergency powers, in the context of a crisis of the parliamentary system. But the theory of the state of exception itself, authored by Carl Schmitt, is linked to a broader critique: that of liberalism, understood as a general idea of order based on strategies of de-politicization of the state. This critical analysis aids an understanding of the scope of Schmitt’s theory of the state of exception and its ambiguity: on the one hand, it may be understood as a reaction against liberal rationalism and its depoliticized conception of order, while on the other, it also offers a solution to this order.

Entgegen dem klassischen Verständnis des Ausnahmezustandes – welches annimmt, dass der Ausnahmezustand ein Bestandteil jeder modernen Form von Verfassungsstaatlichkeit ist – argumentiert der vorliegende Beitrag, dass dieses Konzept in seiner zeitgenössischen Ausprägung betrachtet werden muss. Es erlebte einen ersten Höhepunkt in juristischen Theorien zu Ausnahmekompetenzen während der Zwischenkriegszeit, insbesondere im Zusammenhang mit der Feststellung einer Krise demokratischen Regierens. Aber die Theorie der Ausnahmekompetenzen, wie sie insbesondere von Carl Schmitt formuliert wurde, gründet auf einer breiteren Kritik: nämlich auf einer Kritik des Liberalismus, den er als eine Ordnungsvorstellung, basierend auf Strategien zur Entpolitisierung des Staates, begriff. Diese kritische Analyse fördert ein besseres Verständnis der Tiefe von Schmitts Theorie des Ausnahmezustandes und ihrer Ambivalenz: auf der einen Seite kann diese nämlich als Reaktion gegen den liberalen Rationalismus und seine entpolitisierte Ordnungsvorstellung verstanden werden; auf der anderen Seite eröffnet sie aber auch eine Alternative zu dieser Ordnung.

State of exception vs. “small administrative exceptions”: the meaning of exceptionality in France after the attacks of 2015

Even if it is becoming more and more common in everyday language, the notion of state of exception has been hardly criticized in the academic field this last decade. A broad field of legal and sociological works has mainly objected that there is no “state of exception” in our liberal States, if the state of exception is understood as a general suspension of Law and a situation of anomy. Against this conception, attributed to Carl Schmitt and Giorgio Agamben, a broad amount of works have showed the proliferation of norms and normative activity in “situations of exception” – such as in Guantanamo or in a context of the fight against terrorism. But why do the notions of exception and exceptionality remains so common, and what do they refer to in such a context of normative proliferation?

Based on a reflection about the application of the “Loi sur l’état d’urgence” in France, after the attacks in 2015, and the integration of its main dispositions in the ordinary Law in 2017, this paper aims to question the meaning of exceptionality today in such an executive-administrative State as the French State. With this reflection about exceptionality, I’ll try to shed some light on the transformation of normativity in liberal States today.

Panel “Gegenwartsdiagnosen zum Regieren im Ausnahmezustand”, Basel 2018

Vom 13. bis 15. September 2018 findet in Basel der Vierte Kongress der deutschsprachigen Rechtssoziologievereinigungen statt. Unter dem Oberthema “Abschaffung des Rechts?” werden, wie auch schon auf den Vorgängerveranstaltungen in Luzern, Wien und Berlin, Wissenschaftlerinnen und Wissenschaftler aus der Rechts- und Politikwissenschaft, der Soziologie und weiteren benachbarten Disziplinen miteinander diskutieren.

“Gegenwartsdiagnosen zum Regieren im Ausnahmezustand”, so lautet der Titel des Panels, das Fabien Jobard (Berlin), Ece Göztepe (Ankara), Marie Goupy (Paris) und Matthias Lemke (Lübeck) zum Kongress organisieren. Die Abstracts zu den jeweiligen Vorträgen werden in den kommenden Wochen hier auf dem Blog vorgestellt.

 

63 Jahre État d’urgence in Frankreich

Heute vor 63 Jahren verabschiedete die Französische Nationalversammlung das Gesetz 358/55 über den État d’urgence. Im Kontext des Algerienkrieges erlassen, diente es zuletzt als Grundlage für die Maßnahmen im Kampf gegen den Terrorismus, wie er in Frankreich nach den Anschlägen des 13.11.2015 signifikant verschärft wurde. Am 1. November 2017 lief nach 719 Tagen Dauer der letzte Ausnahmezustand aus. Abgelöst wurde er durch eine Verschärfung des Gesetzes über die Innere Sicherheit, das ausnahmezustandliche Maßnahmen – befristet zunächst für drei Jahre – auch jenseits des Ausnahmezustandes erlaubt.

An aktuellen Analysen liegt von Jean-Claude Paye ein Beitrag zu Sovereignty and the State of Emergency (EN) vor; ebenfalls lesenswert ist das politiktheoretisch akzentuierte Buch von Marie Goupy über L’état d’exception : ou l’impuissance autoritaire de l’Etat à l’époque du libéralisme (FR).

Conference on state of emergency in Rome / Conférence sur l’état d’exception à Rome

Matthias Lemke (Federal University of Applied Administrative Sciences, Faculty of the Federal Police) will give a presentation on “Talking exception. How democracies justify the need for larger competences” (presentation in French). You may download the entire preliminary program for the conference “From dictatorship to state of exception” here. The french speaking conference is organized by Marie Goupy (CIPh / ICP) and Yann Rivière (EHESS) and will take place in the Ecole Française de Rome from May 31st to June 1st 2018.

Matthias Lemke (École supérieure fédérale d’administration publique, faculté de la police fédérale) va présenter une intervention sur “Raconter l’exception. Conference: From Dictatorship to State of Exception

On October 16-17, 2017, the Collège International de Philosophie in Paris will hold a conference on “De la dictature à l’état d’exception. Institutions, droit, théories” (“From dictatorship to state of exception. Institutions, Law, Theories”). Organized by Marie Goupy (CIPh) and Yann Rivière (EHESS), the conference aims at a historical and philosophical reconstruction of the idea of exception. This will include the institutional varieties of emergency powers, as well as the language of the exception. A detailed program can be found here, online inscription is required.

The conference will be held in French.
